DIA TERMS AND CONDITIONS

Last updated: 10 August 2026

These Terms and Conditions govern your use of the DIA website, your purchase of goods and services from us and, where applicable, your membership of the Driving Instructors Association.

Please read these Terms and Conditions carefully before placing an order, purchasing a service or joining the DIA.

The version of these Terms and Conditions in force when you enter into a contract with us will normally apply to that contract. We may update these Terms and Conditions from time to time. Where a change materially affects an ongoing service or membership, we will provide reasonable notice where required.

Nothing in these Terms and Conditions affects any statutory rights that cannot lawfully be excluded or restricted.

1.5. If there is any conflict between these general Terms and Conditions and specific terms supplied for a particular Product, the specific terms will take priority in relation to that Product.

4.2. We may, at our discretion, make certain services, memberships, digital products or other Products available to customers outside the United Kingdom.

4.3. Availability of a Product in a particular country does not mean that all associated benefits or services are available in that country.

4.4. Where we agree to deliver goods outside the United Kingdom, you are responsible for any import duties, taxes, customs charges or other costs imposed by the destination country unless we expressly agree otherwise.

4.5. You are responsible for complying with applicable laws and regulations in the country from which you access or use our Products.

4.6. Specific territorial restrictions relating to DIA insurance benefits are set out in sections 29 and 31.

5. WEBSITE REGISTRATION AND ACCOUNTS

5.1. Some areas of the Website and some Products require you to create an account.

5.2. You must ensure that all information provided when registering or purchasing a Product is accurate, complete and up to date.

5.3. You are responsible for maintaining the confidentiality and security of your username, password and account.

5.4. You must not allow another person to access your account using your login details.

5.5. You must notify us as soon as reasonably possible if you believe your account or login details have been compromised.

5.6.1. Information supplied is false, inaccurate or misleading.

5.6.2. The account is being used fraudulently or unlawfully.

5.6.3. These Terms and Conditions have been materially breached.

5.6.4. Payments due to us have not been made.

5.6.5. Suspension is reasonably necessary to protect DIA, our Members, customers or systems.

5.7. We may use appropriate third-party services for payment verification, identity verification, fraud prevention or security purposes in accordance with our Privacy Policy and applicable data protection law.

6. ELIGIBILITY TO PURCHASE

6.1. To enter into a contract with us, you must:

6.1.1. Be at least 18 years old.

6.1.2. Have legal capacity to enter into a binding contract.

6.1.3. Provide the information reasonably required to complete your purchase.

6.2. Additional eligibility requirements may apply to specific Products, professional training, memberships or insurance benefits.

6.3. DIA membership eligibility and training activity requirements are set out in sections 28, 29 and 31.

7. PRICES

7.1. Prices will be displayed on the Website or otherwise communicated to you before purchase.

7.2. Unless otherwise stated, prices include VAT where VAT is applicable.

7.3. Delivery charges for physical goods are additional unless expressly stated otherwise and will be shown before you complete your order.

7.4. We may change prices at any time before a contract is formed.

7.5. If a Product has been incorrectly priced, we are not required to supply it at the incorrect price where the error is obvious and could reasonably have been recognised as an error.

7.6. If we identify a pricing error after you place an order but before the Product is supplied, we may contact you and offer you the opportunity to proceed at the correct price or cancel the order.

7.7. Membership fee changes are dealt with separately under section 28.

8. PAYMENT

8.1. Payment may be made using the payment methods displayed or approved by us at the time of purchase, including Direct Debit, debit or credit card and approved electronic payment methods.

8.5. We may use third-party payment processors to collect and administer payments.

8.6. If a payment fails or is declined, we may contact you to request an alternative payment method or to resolve the payment issue.

8.7. Failure to make a payment when due may result in suspension or termination of the relevant Product, service or membership.

8.8. Where a minimum contractual commitment applies, failure or cancellation of a payment method does not by itself cancel the underlying contract or remove any payment obligations already due.

9. ORDER PROCESS AND FORMATION OF A CONTRACT

9.1. All orders are subject to acceptance and availability.

9.2. Placing an order constitutes an offer by you to purchase the relevant Product.

9.3. An automated acknowledgement confirming that we have received your order does not necessarily constitute acceptance.

9.4. A contract will normally be formed when we confirm acceptance of your order, dispatch goods, provide access to a service or digital Product, confirm your membership or otherwise begin supplying the Product.

9.5. We may refuse an order before acceptance where we have a legitimate reason to do so.

9.6. You are responsible for checking that the information supplied when placing your order is correct.

9.7. Where a service or membership has a minimum term, that minimum term will be stated before purchase or within the relevant specific terms.

9.8. Where you agree to automatic renewal, the Product may continue or renew in accordance with the agreed renewal terms until validly cancelled.

9.9. Any statutory renewal notices, reminders or cancellation rights required by applicable law will apply in addition to these Terms and Conditions.

10. DELIVERY OF GOODS AND PERFORMANCE OF SERVICES

10.1. Goods will be delivered to the address supplied when you place your order.

10.2. You are responsible for ensuring that the delivery address is correct.

10.3. Any estimated delivery or service completion date is an estimate unless we expressly agree that the date is essential.

10.4. Where you are a Consumer, we will deliver goods within the period required by applicable consumer law unless a different delivery period has been agreed with you.

10.5. We may deliver an order in more than one instalment where reasonably necessary.

10.6. Services may be delivered in person, online, by telephone, by video conferencing, through an online learning system or using another method appropriate to the service.

10.7. We will provide services with reasonable care and skill.

11. RISK AND OWNERSHIP OF GOODS

11.1. Where you are a Consumer, responsibility for goods passes to you when you, or a person nominated by you, takes physical possession of them.

11.2. Where you are a Business Customer, risk passes to you on delivery unless otherwise agreed.

11.3. Ownership of goods will not pass to you until we have received payment in full for those goods.

12. CANCELLATION, RETURNS AND REFUNDS

Consumer statutory cancellation rights

12.1. This section sets out certain cancellation rights available to Consumers. These rights are in addition to any other statutory rights you may have.

12.2. Statutory consumer cancellation rights do not generally apply where you purchase a Product wholly or mainly for purposes connected with your trade, business, craft or profession.

Goods purchased online or at a distance

12.3. If you are a Consumer purchasing goods online or through another qualifying distance contract, you will normally have 14 days after receiving the goods to notify us that you wish to cancel the contract without giving a reason.

12.4. If an order contains multiple goods delivered on different dates, the applicable cancellation period will be determined in accordance with consumer law.

12.5. To exercise your cancellation right, you must clearly inform us of your decision to cancel.

You may contact us at:

Email: help@driving.org

Post:
DIA
11 Gleneagles Court
Brighton Road
Crawley
RH10 6AD

12.6. Unless we agree to collect the goods, you must return them within 14 days of notifying us of your cancellation.

12.7. Unless we have agreed otherwise, you are responsible for the direct cost of returning unwanted goods.

12.8. You must take reasonable care of goods while they are in your possession. We may make a lawful deduction from a refund where the value of goods has been reduced by handling beyond what would reasonably be necessary to establish their nature, characteristics and functioning.

Refunds following cancellation of goods

12.9. Where you validly exercise a statutory cancellation right, we will refund payments due to you in accordance with applicable consumer law.

12.10. Where applicable, the refund will include the cost of our standard delivery method. Additional delivery charges resulting from your choice of a more expensive delivery method may not be refundable.

12.11. We may withhold a refund until we have received returned goods or you provide appropriate evidence that the goods have been returned, where permitted by law.

Services

12.12. If you are a Consumer purchasing a service through a qualifying distance or off-premises contract, you will normally have 14 days from the date the contract is entered into to cancel without giving a reason.

12.13. If you ask us to begin providing a service during the 14-day cancellation period and subsequently cancel, you may be required to pay a proportionate amount for services supplied up to the date of cancellation where permitted by law.

12.14. Where a service has been fully performed during the cancellation period following your express request and acknowledgement, your statutory cancellation right may end once the service has been fully performed where permitted by law.

Digital content

12.15. Where digital content is supplied immediately, you may be asked to expressly consent to supply beginning during the statutory cancellation period and to acknowledge any effect this has on your cancellation rights.

12.16. Where required by law, we will not supply digital content during the cancellation period without obtaining the necessary consent and acknowledgement.

Exceptions

12.17. Statutory cancellation rights may not apply to certain Products, including where permitted by law:

12.17.1. Goods made to your specifications or clearly personalised.

12.17.2. Goods liable to deteriorate or expire rapidly.

12.17.3. Sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed.

12.17.4. Sealed audio, video or computer software once unsealed.

12.17.5. Newspapers, periodicals or magazines, other than subscription contracts where statutory rights apply.

12.17.6. Certain digital content supplied with the required consent and acknowledgement.

12.17.7. Other Products excluded from statutory cancellation rights by law.

Faulty or misdescribed Products

12.18. Goods supplied to Consumers must meet the standards required by applicable consumer law, including requirements relating to satisfactory quality, fitness for purpose and correspondence with description.

12.19. Services supplied to Consumers must be provided with reasonable care and skill.

12.20. Digital content supplied to Consumers must comply with applicable statutory requirements.

12.21. If you believe a Product is faulty, damaged, misdescribed or has not been supplied with reasonable care and skill, please contact help@driving.org as soon as reasonably possible.

12.22. Nothing in these Terms and Conditions limits your statutory remedies in respect of faulty goods, services or digital content.

Business Customers

12.23. Where you purchase a Product as a Business Customer, cancellation rights will be those expressly set out in the relevant contract or Product terms unless legislation provides otherwise.

DIA Membership

12.24. DIA membership has separate contractual cancellation provisions, including the first-time member cooling-off period and membership cancellation requirements set out in section 28.

13. COMPLAINTS

13.1. If you have a complaint or concern about a Product, service or membership, please contact us in the first instance.

14. INTELLECTUAL PROPERTY

14.1. The Website and its content, including text, designs, graphics, logos, images, videos, course materials, downloadable materials, databases, software and other content, are protected by intellectual property laws.

14.2. Intellectual property rights in content supplied by us remain owned by DIA or the relevant licensors.

16.3. We are not responsible for losses which were not foreseeable or which result from circumstances outside our reasonable control.

16.4. Where you are a Consumer, we do not exclude or restrict your statutory rights.

Business Customers

16.5. Where you are acting as a Business Customer, and to the fullest extent permitted by law, we will not be liable for indirect or consequential loss or for loss of profit, revenue, business, anticipated savings, goodwill, opportunity or data.

16.6. Subject to clause 16.1, our total liability arising in connection with a particular Product or contract will not exceed the total amount paid or payable by you for that Product or contract during the preceding 12 months, unless a different liability limit is expressly agreed in writing.

Website and third-party services

16.7. We do not guarantee that the Website will always be available, uninterrupted or free from errors.

16.8. We are not responsible for failures caused by third-party systems, internet providers, payment providers or other matters outside our reasonable control.

16.9. Some DIA benefits and offers are provided by independent third parties. Unless expressly stated otherwise, the third party is responsible for supplying its own products or services and its own terms may apply.

16.10. Nothing in this section affects the specific terms governing DIA-arranged insurance.

17. EVENTS OUTSIDE OUR REASONABLE CONTROL

17.1. We will not be liable for delay or failure to perform obligations caused by events outside our reasonable control.

17.2. Such events may include:

17.2.1. Industrial disputes.

17.2.3. Fire, flood, extreme weather or natural disaster.

17.2.4. Epidemic or pandemic.

17.2.5. War, terrorism, civil unrest or government action.

17.2.6. Transport disruption.

17.2.7. Failure of suppliers or venues caused by circumstances outside our reasonable control.

17.2.8. Any comparable event which we could not reasonably have prevented.

17.3. Where such an event occurs, we will take reasonable steps to minimise disruption and resume performance where reasonably practicable.

18. PRIVACY AND DATA PROTECTION

18.1. We process personal information in accordance with applicable UK data protection law, including the UK GDPR and Data Protection Act 2018, as amended from time to time.

18.2. Further information about how we collect, use, store and share personal information is set out in our Privacy Policy.

18.3. We may record telephone calls for purposes including training, monitoring, customer service, dispute resolution and regulatory or security requirements where lawful.

18.4. Where we use third-party providers to deliver Products or benefits, personal information may be shared with those providers where necessary and lawful to provide the relevant service.

19. THIRD-PARTY RIGHTS

19.1. Unless expressly stated otherwise, a person who is not a party to a contract with us has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce its terms.

19.2. This does not affect any right or remedy available to a third party independently of that Act.

20. EXTERNAL LINKS

20.1. The Website may contain links to websites or services operated by third parties.

20.2. We are not responsible for the content, availability, security or privacy practices of third-party websites.

20.3. A link from our Website does not necessarily constitute our endorsement of the third party or its products or services.

20.4. Your use of third-party websites and services is subject to their own terms and policies.

21. LINKING TO THE WEBSITE

21.1. You may link to publicly available pages of the Website provided that the link is lawful, fair and does not damage or take unfair advantage of our reputation.

21.2. You must not create a link which falsely suggests association, approval, partnership or endorsement by DIA.

21.3. You must not frame the Website within another website or reproduce substantial parts of the Website without our written permission.

23.2. Nothing in this section excludes liability for fraud or fraudulent misrepresentation.

24. GENERAL

24.1. We may update the Website, Product descriptions and Products from time to time.

24.2. Changes to Products already contracted for will only be made where permitted by the relevant contract and applicable law.

24.3. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in effect.

24.4. A delay or failure by us to enforce a right does not amount to a waiver of that right.

24.5. Any waiver must be expressly given.

24.6. Contracts are concluded in English unless expressly agreed otherwise.

24.7. You may not transfer your contractual rights or obligations to another person without our prior written consent, except where applicable law permits otherwise.

24.8. We may transfer our rights or obligations to another organisation where this does not materially prejudice your rights and where permitted by law.

25. GOVERNING LAW AND JURISDICTION

25.1. These Terms and Conditions and contracts entered into under them are governed by the law of England and Wales.

25.2. Where you are a Business Customer, the courts of England and Wales will have exclusive jurisdiction in relation to disputes arising from these Terms and Conditions or your contract with us.

25.3. Where you are a Consumer, nothing in these Terms and Conditions prevents you from relying on any mandatory rights relating to governing law or jurisdiction which apply in the part of the United Kingdom in which you live.

26. FIND A DRIVING INSTRUCTOR

26.1. DIA’s Find a Driving Instructor service is intended to help individual users locate driving instructors.

26.2. Information displayed through the service must not be collected or used for unsolicited mass communication, marketing, data harvesting or similar purposes.

26.3. You must not use automated tools, scraping systems or other methods to systematically extract instructor data from the service without our prior written permission.

26.4. We may restrict or block access where we reasonably believe the service is being misused.

27. CPD VOUCHERS

27.1. Eligible DIA Members may receive a £25 discount against qualifying DIA CPD courses where this benefit is included with their membership.

27.2. The CPD voucher is valid until 31 December of the calendar year in which it is issued unless otherwise stated.

27.3. Unused voucher value cannot be carried forward into a subsequent calendar year.

27.4. The CPD voucher cannot be used in conjunction with another promotion, discount or offer unless expressly stated otherwise.

27.5. The voucher has no cash value and cannot be exchanged for cash.

28. DIA MEMBERSHIP

Acceptance of Membership Terms

28.1. By joining or renewing your DIA membership, you agree to comply with these Terms and Conditions, the Rules of the DIA, our Privacy Policy and the DIA Code of Conduct.

Cooling-Off Period

28.2. New members joining the DIA for the first time have a 14-day cooling-off period from the date their membership begins, during which they may cancel their membership.

28.3. This contractual cooling-off period applies to the initial membership only and does not apply to subsequent renewals or renewal periods, except where a statutory cancellation or cooling-off right applies by law.

Membership Commitment

28.4. DIA membership requires a minimum commitment of one year unless the membership plan or offer expressly states otherwise.

Cancelling Your Membership

28.5. Members wishing to cancel their DIA membership must submit a cancellation request using the DIA cancellation form at:

https://www.driving.org/cancel/

28.6. Cancellation requests must be submitted at least 30 working days before your next scheduled payment or renewal date to avoid further charges.

28.7. Where membership is paid quarterly, the minimum membership commitment remains one year. If you cancel before the end of the agreed one-year period, you will remain responsible for payment of any remaining quarterly instalments due for that membership year.

28.8. Cancelling a Direct Debit, card payment instruction or other payment method does not itself constitute cancellation of your DIA membership. Membership must be cancelled using the process set out above.

28.9. Our membership team will contact you following submission of the cancellation form to confirm and process your request.

Membership Renewal

28.10. Where your membership is set to renew automatically, it will continue in accordance with the renewal and payment arrangements agreed with you unless a valid cancellation request is received within the required notice period.

28.11. Where legislation requires DIA to provide additional renewal information, reminders or cancellation rights, those statutory requirements will apply.

Membership Fees

28.12. All DIA membership plans are subject to an annual fee review to reflect inflation, rising operational costs and the cost of providing membership services and benefits.

28.13. Any annual membership fee adjustment will normally take effect in September and may apply to all Members regardless of when their membership started or last renewed.

28.14. We will provide at least 30 days’ notice before any membership fee change takes effect.

28.15. By continuing your membership after the new fee takes effect, you will be deemed to have accepted the revised membership fee, subject to any statutory rights you may have.

Membership Benefits

28.16. All member benefits, discounts, offers and services are subject to availability and may vary according to your membership plan.

28.17. Member benefits, discounts, offers and services provided by DIA or associated third-party providers may be amended, replaced, suspended or withdrawn from time to time.

28.18. Unless expressly stated otherwise, the availability of a particular benefit, discount or promotional offer when you join does not guarantee that it will remain available throughout your membership term.

28.19. Withdrawal or alteration of an ancillary benefit, discount or promotional offer does not by itself give rise to a right to compensation or refund, except where required by law or otherwise expressly provided by these Terms and Conditions.

Insurance Eligibility

28.20. Public Liability and Professional Indemnity insurance is not available as part of DIA membership for trainers based in the Republic of Ireland.

28.21. To be eligible for DIA-arranged Professional Indemnity and Public Liability insurance, your membership type must be appropriate for the training activities you deliver and those activities must be accurately declared to DIA.

28.22. Members are responsible for providing accurate and complete information about the training activities they deliver and for ensuring they hold the appropriate DIA membership type. Failure to do so may affect insurance cover or result in an insurance claim being declined in accordance with the applicable policy terms.

Membership Lapse and Renewal

28.23. If your membership lapses, DIA may allow a 30-day grace period for renewal.

28.24. During this period, you may continue to have access to selected core DIA services, such as the Helpdesk.

28.25. The 30-day grace period does not guarantee or automatically extend Professional Indemnity or Public Liability insurance cover.

28.26. Any claim relating to a period during which membership was inactive or had lapsed will be subject to the applicable insurance policy terms and eligibility requirements and may not be covered.

28.27. A re-joining fee may apply if membership is not renewed within the 30-day grace period.

Suspension or Termination

28.28. DIA may suspend or terminate membership where reasonably justified, including where:

28.28.1. Membership fees remain unpaid.

28.28.2. Materially false or misleading information has been provided.

28.28.3. These Terms and Conditions, the Rules of the DIA or the DIA Code of Conduct have been materially or repeatedly breached.

28.28.4. Membership or DIA services are used fraudulently or unlawfully.

28.28.5. The Member no longer meets the applicable membership eligibility requirements.

28.29. Suspension or termination of membership may result in the loss of membership benefits and any insurance benefit dependent upon active membership.

29. PROFESSIONAL INDEMNITY AND PUBLIC LIABILITY INSURANCE

29.1. Professional Indemnity and Public Liability insurance arranged through DIA is a membership benefit available only to eligible Members and is subject at all times to the applicable insurance policy wording, terms, conditions, limits and exclusions.

29.2. Insurance cover is only available while the Member satisfies the applicable membership and insurance eligibility requirements.

Republic of Ireland

29.3. Professional Indemnity and Public Liability insurance arranged through DIA is not available for trainers based in the Republic of Ireland.

Group Insurance Certificate

29.4. DIA-arranged Professional Indemnity and Public Liability insurance is provided under group insurance arrangements covering eligible DIA Members.

29.5. As a result, insurance certificates may show the group policy period and will not necessarily display an individual Member’s personal details.

29.6. Where evidence of eligibility is required, the insurance certificate should be supported by current evidence of DIA membership, such as a DIA Certificate of Membership, membership card or other membership verification provided by DIA.

Motor Insurance

29.7. DIA-arranged Professional Indemnity and Public Liability insurance does not replace motor insurance.

29.8. Members are responsible for ensuring that appropriate motor insurance is maintained for any vehicle used for driver or rider training where required.

29.9. Injury, damage or liability arising in circumstances governed by compulsory motor insurance or the Road Traffic Act may fall under the applicable motor insurance rather than the Professional Indemnity or Public Liability policy.

Appropriate Insurance

29.10. Members must ensure that all insurance required for their activities is in place.

29.11. DIA Professional Indemnity and Public Liability insurance does not provide cover outside the scope of the applicable policy.

29.12. Members should read the insurance documentation carefully, including all exclusions, conditions and limitations.

29.13. Where there is any conflict between a general description of the insurance benefit in DIA marketing or membership material and the applicable insurance policy wording, the policy wording will determine the scope of insurance cover.

29.14. Acceptance or rejection of an insurance claim is subject to the applicable policy terms, circumstances of the claim and the insurer’s claims process.

30. RECOMMEND A FRIEND

30.1. Where the DIA Recommend a Friend offer is available, an eligible Member who recommends a person who subsequently joins DIA may receive the reward advertised at the time of referral.

30.2. Under the current offer, an eligible Member will receive a £20 Amazon.co.uk Gift Card when a qualifying recommended friend joins the DIA.
